ABOUT
1. Safe Secure Seniors is a service that allows customers to find outstanding information regarding senior care and assisted living facilities based on factual rather than social data. These sources include government inspection reports, Better Business Bureau filings, and other data sources, all consolidated into a single source for making comparisons of prospective facilities based on a customer's criteria easy.
ELIGIBILITY
1. You are at least 13 years of age.
2. You use the Website and Services according to these Terms and all applicable laws and regulations determined by the country of residence.
3. You provide complete and accurate registration information and maintain accurate registration information on the Website.
4. You agree and understand that SafeSecureSeniors may, at any time, and without prior notice, revoke and/or cancel your access if you fail to meet these criteria or violate any portion of these Terms.
ACCOUNTS
1. When you create an account with us, you guarantee that you are above the age of 13, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.
2. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account.
3. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service.

REGISTRATION, LOGIN CREDENTIALS AND SECURITY
1. In order to be able to make use of and access the Services, you shall register on the Website by providing the SafeSecureSeniors with all required information which includes but is not limited to your full name, business name, address and contact information.

  6. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Service, or which, as determined by us, may harm or offend SafeSecureSeniors or users of Service or expose them to liability.
4. Additionally, you agree not to:
  1. Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party's use of Service, including their ability to engage in real time activities through Service.

PURCHASES
1. If you wish to purchase any product made available through Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
2. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
3. We may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
4. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
5. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
SUBSCRIPTIONS
1. Some parts of Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a 24h, monthly and annually basis.
2. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or SafeSecureSeniors cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting SafeSecureSeniors customer support team.
3. A valid payment method, including credit card, is required to process the payment for your subscription. You shall provide SafeSecureSeniors with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information.
4. By submitting such payment information, you automatically authorize SafeSecureSeniors to charge all Subscription fees incurred through your account to any such payment instruments.
5. Should automatic billing fail to occur for any reason, SafeSecureSeniors will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
AUTOMATIC RENEWAL AND CONTINUOUS SERVICE
1. By subscribing to our services/products, you acknowledge and agree that your subscription will automatically renew unless you cancel it. You authorize us to initiate recurring charges to your designated billing method without further authorization from you until you provide prior notice that you wish to terminate this authorization or to change your payment method.
2. Before completing the subscription, you will be provided with the terms of the automatic renewal and continuous service in a clear and conspicuous manner, including the length of the automatic renewal term, the cost of the renewal, and any changes that will occur after an introductory or promotional period end.
3. If your subscription includes a free trial or promotional pricing that lasts for 31 days or more, you will receive a notice outlining how to cancel in advance of being charged, at least 3 days and no more than 21 days before the end of the free or discounted period.
4. For services with an initial term of one year or longer, a renewal notice will be provided at least 15 days and not more than 45 days before the renewal date. This notice will detail the renewal terms and outline how you can cancel your subscription.
5. You may cancel your automatic renewal or continuous service at any time. To ensure ease of cancellation, we provide the following methods: (a) A prominently located direct link or button for cancellation within your account profile or settings. (b) An easily accessible termination email formatted by us, which you can send without needing to provide additional information.
6. You are entitled to cancel the service online, and any steps required to cancel will not obstruct or unnecessarily delay your ability to terminate the service immediately.
7. If you receive any notices electronically from us regarding your subscription, these will include a direct link to the cancellation process, or an alternative method that is easily accessible, helping you to navigate the cancellation process smoothly.
8. Should there be any material change to the terms of your subscription, you will be provided with a clear and conspicuous notice of these changes and information on how to cancel in a manner that you can retain before the changes take effect. By subscribing to our services, you agree to these terms and acknowledge that you have read and understood our automatic renewal and cancellation policies.
FEE CHANGES
1. SafeSecureSeniors, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions.
2. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
3. SafeSecureSeniors will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
4. Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
REFUNDS
1. Except when required by law, paid Subscription fees are non-refundable
INTELLECTUAL PROPERTY
1. Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of SafeSecureSeniors and its licensors.
2. Service is protected by patent, copyright, trademark, and other laws of the State of Georgia.
3. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SafeSecureSeniors.
4. Unauthorized use of any materials contained on this Website, our applications or within the Service may violate copyright laws, trademark laws, the laws of privacy and publicity, and/or other regulations and statutes. If you believe that any of the materials infringe on any third party's rights, please contact SafeSecureSeniors immediately at: info@safesecureseniors.com
5. All content, trademarks, data, information or information contained in any materials, or documents used in relation to SafeSecureSeniors and the Services, including but not limited to any and all copyrighted works, software, databases, text, graphics, icons, designs, logos, graphics, hyperlinks, domain names, information and agreements ("Content"), are the exclusive property of or are licensed to SafeSecureSeniors. You may not reproduce, distribute or copy the Content by any means, whether electronically or not, without SafeSecureSeniors’s prior written permission.

Any and all intellectual property rights in the Content, Services and SafeSecureSeniors or otherwise developed by or on behalf of SafeSecureSeniors, including all patents, rights in inventions, rights in designs, trademarks, trade and business names and all associated goodwill, rights to sue for passing off or for unlawful competition, copyright, moral rights and related rights, rights in databases, topography rights, domain names, rights in information (including know how and trade secrets) and all other similar or equivalent rights existing in the Content, Services and SafeSecureSeniors or otherwise developed by or on behalf of SafeSecureSeniors, now or in the future in any part of the world, in each case whether registered or unregistered and including all applications for, and renewals or extensions of, such rights for their full term ("Intellectual Property"), vests in the SafeSecureSeniors its licensors or suppliers, as the case may be, and all rights not expressly granted by SafeSecureSeniors to you are reserved by SafeSecureSeniors.
7. Save as expressly set out herein and in the Contracts, you shall not acquire any right, title or interest in SafeSecureSeniors's Intellectual Property. You may not use SafeSecureSeniors's Intellectual Property in a manner which may (i) place SafeSecureSeniors's Intellectual Property at risk of losing value, and (ii) cause reputational damage to the SafeSecureSeniors.
8. You may only use the Service as expressly permitted by these Terms. All rights not expressly granted to you are reserved by SafeSecureSeniors, its third-party providers and other respective owners, if any.
9. Subject to these Terms, and your compliance with these Terms, SafeSecureSeniors hereby grants you a limited, personal, non-exclusive, non-sub-licensable and non-transferable license to use the Content and to use this Service, in each case solely for your personal use. You agree not to use the Service or any of the Content for any commercial purpose. Except for the foregoing license, you have no other rights to the Service or any Content, and you may not modify, edit, copy, distribute, reproduce, publish, display, perform, license, sell, rent, lease, loan, create derivative works of, create any index, reverse engineer, alter, enhance, provide access to or in any way exploit the Service or Content in any manner.
10. If you breach any of these Terms, the above license will terminate automatically.
ERROR REPORTING AND FEEDBACK
1. You may provide us either directly at info@safesecureseniors.com or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). You acknowledge and agree that:
  1. you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback;
  2. SafeSecureSeniors may have development ideas similar to the Feedback;
  3. Feedback does not contain confidential information or proprietary information from you or any third party; and

In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant the SafeSecureSeniors and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

GOVERNING LAW
1. These Terms shall be governed and construed in accordance with the laws of State of Georgia without regard to its conflict of law provisions.
2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
3. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.
4. Each party irrevocably agrees that the courts of State of Georgia shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
5. Notwithstanding the specified agreement on jurisdiction, you and the SafeSecureSeniors shall, if any dispute arises, attempt to settle it by mutual negotiations.
6. You agree that for the purposes of the settlement of disputes between you and SafeSecureSeniors, an e-mail correspondence with the authorized persons of the SafeSecureSeniors at: info@safesecureseniors.com shall be the effective and binding method of communication.
CHANGES TO SERVICE
1. We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice.
2. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period.

2. If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.
